Terms & Conditions

1. ACCEPTANCE AND DELIVERY

1.1 Receipt of the concrete and/or signing of the delivery note by the Customer or the Customer’s representative constitutes full and unconditional acceptance of the quantity, mix design, and apparent condition of the concrete at the time of delivery.
1.2 Concrete quantities are subject to industry-standard tolerances. Any claim relating to quantity discrepancies must be raised immediately upon delivery and in any case no later than three (3) days from the date of casting.

2. PRODUCT SPECIFICATION AND QUALITY

2.1 The concrete supplied conforms to the approved mix design and applicable
standards as specified in the purchase order.
2.2 TREMIX is responsible solely for the quality of the concrete as supplied and as represented by approved test specimens taken in accordance with industry standards.
2.3 TREMIX shall not be responsible for performance issues arising from:
• Improper handling, placement, compaction, or curing
• Adverse weather conditions
• Delays in discharge or placement
• Site conditions beyond the Company’s control
• Execution methods or other site-related quality parameters
2.4 Any material added on site by third parties or the Contractor, including but not limited to water or admixtures, shall be entirely outside TREMIX’s responsibility.

3. PARTIAL DELIVERY AND PAYMENT

3.1 In the event the Buyer accepts or takes delivery of only part of the ordered load, the Buyer shall nevertheless be liable to pay the full purchase price of the entire load ordered.

4. DISCHARGE TIME AND WAITING CHARGES

4.1 The standard time allowed for unloading is five (5) minutes per cubic meter (or part thereof) delivered, and shall in all cases not exceed two (2) hours from loading time.
4.2 The delivery truck shall be checked and discharge commenced immediately upon arrival at site. Standard discharge time applies from the time of arrival.
4.3 TREMIX reserves the right to charge detention or waiting time in excess of the standard period at prevailing rates.
4.4 Rejection of concrete shall not be accepted where quality parameters are affected due to:
• Excessive waiting time
• Site-related delays
• Failure to commence discharge promptly
• Discharge time exceeding two (2) hours from loading time

5. CARBONCURE TECHNOLOGY

5.1 Delivered concrete may incorporate Carbon Cure technology, which:
• Reduces cement content by approximately 5%
• Injects 0.1% CO₂ to enhance concrete strength
• Reduces carbon footprint and supports sustainable construction standards such as LEED and Estidama
5.2 Written confirmation must be provided by the Contractor prior to delivery if
CarbonCure concrete is not permitted for use in the project.

6. TEMPERATURE CONTROL

6.1 Rejection of concrete due to temperature shall not be accepted where the Customer has failed to request and pay for adequate temperature-control measures.
6.2 If the Contractor elects to waive temperature control charges, TREMIX shall not be responsible for any quality issues arising from inadequate temperature control, including but not limited to:
• Thermal cracking
• Strength reduction
• Accelerated setting
• Surface defects
• Any other temperature-related deficiencies
6.3 Once concrete has been cast, all responsibility for temperature-related issues
remains with the Contractor.

7. COMPLAINTS AND CLAIMS

7.1 Any complaint regarding quality must be submitted in writing within thirty (30) days from the date of delivery.
7.2 No claims shall be accepted where:
• The concrete has been altered or mixed with other materials
• Discharge time exceeds two (2) hours from loading time
• The delivered concrete does not match the specifications in the purchase order and has already been cast
• Adequate notice and opportunity for inspection were not provided to TREMIX

8. REJECTION OF CONCRETE

8.1 Rejection of concrete is acceptable only prior to placement or use.
8.2 Once the concrete has been placed, cast, or used in any manner, rejection shall not be accepted and full responsibility shall rest with the Contractor.

9. SCOPE AND APPLICABILITY

9.1 These Terms & Conditions apply exclusively to the concrete delivered on the date and time stated on the delivery note.
9.2 These terms form an integral part of the contract between TREMIX and the Customer and supersede any prior oral or written representations.

ACKNOWLEDGMENT

By accepting delivery and/or signing the delivery note, the Customer acknowledges having read, understood, and agreed to be bound by these Terms & Conditions.
